Is POSH compliance mandatory for all companies in India?

Yes. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 applies to every organisation in India with 10 or more employees — including startups, NGOs, private limited companies, and public sector undertakings. There is no exemption based on industry, revenue, or structure. Non-compliance carries penalties of up to ₹50,000 and licence cancellation on repeat violations.

What are the mandatory requirements under the POSH Act?

Mandatory requirements include: a written POSH policy displayed at the workplace, constitution of an Internal Committee (IC) with at least one external member, regular awareness training for all employees, a documented complaint management process, completion of all investigations within 90 days, and annual reporting to the District Officer. Failure on any of these counts as non-compliance.

Who can be an external member on the Internal Committee?

The external member must be from an NGO or association committed to the cause of women, or a person familiar with issues relating to sexual harassment. They cannot be an employee of your organisation. Maslo sources qualified external members for client ICs as part of our engagement — this is one of the most commonly missed requirements in DIY POSH setups.

What happens if a complaint is filed and our IC is not trained?

An untrained IC conducting an investigation creates serious legal risk for both the company and individual IC members. Procedural errors — failing to follow natural justice, improper evidence handling, or missing timelines — can invalidate the inquiry and expose the company to legal challenges from either party. Maslo provides IC certification training and live investigation support to eliminate this risk.

How long does it take to get POSH compliant with Maslo?
