What "audit-ready" means at year-end

Most POSH gaps are found at the same moment — when a complaint, a client audit or a statutory review asks for evidence. These are the three things we see missing most often.

An annual report

The Internal Committee must prepare a report every calendar year (Section 21) and submit it to the employer and the District Officer. Year-end is when this falls due.

A valid committee

Presiding Officer, employee members and an external member — with nominations inside the 3-year term. Lapsed nominations are the most common finding.

Proof of awareness

Display of the IC order and penal consequences, plus regular workshops with attendance records (Section 19). If it isn't documented, it didn't happen.

Frequently asked questions

Which employers must have an Internal Committee?

Every employer with 10 or more employees at an office or branch must constitute an Internal Committee under Section 4 of the POSH Act, 2013. For establishments with fewer than 10 employees, a Local Committee set up by the District Officer handles complaints.

What is the POSH annual report and who receives it?

Under Section 21, the Internal Committee prepares an annual report for each calendar year and submits it to the employer and the District Officer. Section 22 also requires employers to disclose the number of cases filed and disposed of in their own annual report, where one is required.

What is the penalty for not complying?

Under Section 26, non-compliance such as not constituting an Internal Committee can attract a penalty of up to ₹50,000, with higher penalties and possible cancellation of licence or registration for repeat contraventions.

How long does an inquiry have to take?

The Internal Committee must complete the inquiry within 90 days (Section 11), submit its report within 10 days of completion (Section 13), and the employer must act on the recommendations within 60 days.

Does POSH apply to remote work, interns and contract staff?

Yes. The Act's definition of "employee" covers regular, temporary, contract, intern and trainee staff, and "workplace" extends to any place visited in the course of employment, including transport and remote or client locations.
